The work of the group aims to inform the public about the specificities of the military system, particularly to strengthen the rights of the parties in military trial.

Nearly 2,000 judicial proceedings are conducted annually by military authorities. Yet, military justice remains largely unknown to the general public and to many practitioners who seldom practice their craft in this specialized jurisdiction. In the words of Sun Tzu, the art of war lies in preparation and the quality of intelligence gathered: "He who knows others and knows himself will not be endangered in a hundred engagements; he who does not know others but knows himself will for every victory suffer a defeat […]". Understanding the stakes of a military trial is therefore crucial to ensure the effectiveness of the rights of participants who are not familiar with military matters, thereby maintaining equality of arms. More importantly, beyond judicial victory or defeat, understanding the "proper conduct" of the procedure helps to establish a sense of justice being served.

    Summary : This contribution studies the jurisprudence of military courts rendered in the last decade. The author examines the practical consequences of the Military Court of Cassation's interpretation of the notions of "foreign army" and "military service" since 1928. In particular, the author is interested in the relevance of maintaining subjection to a military or "quasi-military" command as the intangible core of "foreign military service" in the context of modern wars (notably cyberwars) and with the emergence of new disorganized armed entities. To reinforce Article 94 of the Military Penal Code's effectiveness: new avenues of reflection are presented, including introducing a central criterion of "active participation in military efforts", which can cover any civilian or military action deployed within a war effort.
