Private international law and family law

The project examines cross-border parentage, as well as Swiss substantive law on parentage. As these fields remain in constant evolution, the project involves ongoing monitoring and in-depth analysis of:

• the progress of the European filiation regulation project and related soft-law instruments;
• the case law of the European Court of Human Rights on cross-border parentage and its application within Member States;
• upcoming revisions to Swiss parentage law and to the Federal Act on Medically Assisted Reproduction, as well as other possible family law reforms;
• major legislative and jurisprudential developments in other States regarding surrogacy and transnational surrogacy.

The project also encompasses broader monitoring and analysis of emerging issues in private international law and civil law.
