According to Nicolas Bueno, Professor of Law at UniDistance Suisse, Switzerland is lagging behind in tackling products derived from forced labor. As the United States threatens to impose new tariffs, this situation highlights growing legal and economic challenges.

The United States is considering imposing additional tariffs of up to 12.5% on around sixty countries, including Switzerland. This measure is justified by what it considers insufficient efforts to combat the import of goods linked to forced labor. While the United States already has legislation in this area and the European Union will introduce a similar framework by 2027, Switzerland does not currently plan to implement a general import ban. 

A complex response to implement

For Nicolas Bueno, Professor of Law at UniDistance Suisse, Switzerland should ban the import of products derived from forced labor. However, “such a measure would take time and would not necessarily prevent U.S. sanctions,” he notes. In practice, identifying such products within globalized supply chains represents a significant challenge for authorities, meaning Switzerland would not be immune to American criticism. 

Between ethical requirements and economic considerations

According to him, the U.S. position must also be understood in a broader context. “The United States also uses the fight against forced labor as an instrument of economic policy,” he emphasizes. While the U.S. has an import ban mechanism, its requirements for companies remain less extensive than those of the European Union, which imposes stricter obligations regarding supply chain due diligence. 

In this context, Switzerland is considering strengthening the obligations of large companies operating abroad. These developments reflect a shifting legal framework at the intersection of economic, legal, and ethical imperatives.
