Ana Carla Farrèr Gonçalves rédige un doctorat sur l'interprétation judiciaire de l'intention terroriste (« Intent to Commit Terrorism and Transitional Justice: How Lived Experiences of Conflict Influence Judicial Interpretations of Mens Rea »).
Abstract
The research project aims to analyze how the "intent to commit terrorism" or mens rea of the crime of terrorism is interpreted across different legal contexts, specifically examining the impact that a jurisdiction's lived experience with internal or external conflict, and its engagement with transitional justice processes, has on judicial interpretation. This project expects to deliver insights into how historical and socio-political contexts shape the judicial interpretation of criminal intent. Specifically, the project will demonstrate how a jurisdiction's proximity to mass conflict or political transition systematically alters the way judges impute mental culpability in counter-terrorism prosecutions. These findings will also evaluate how these contextual shifts impact core principles of substantive criminal law, most notably the principle of legality.
